Interpretation:
The definitions and rules of interpretation in this clause apply in this agreement.

"Serb" refers to the website flyserb.com, which offers users a variety of services based on their preferences.
"The agreement" refers to this agreement which governs users' use of Serb.
"Services" refers to all services provided/will be provided by Serb such as (Recreational Pilots guidelines: Pilot licenses)- (UTM service: drone registration, payload registration, incident reporting, flight operation log book, user reports, designated safe zones in oman, active flight information)
"Pilot" means a person operating as the pilot in command or remote pilot operating an RPA.
"enterprise" a corporation, a firm or a company who has logged on to this website and has agreed to the Company's terms and conditions.
"AirPass"AirPass is the license we issue to drone pilots, certified by the Civil Aviation Authority (CAA). Drone operation permit (DOP): refers to the drone operating permit that is granted to the registered users.
"Drone" Remote pilot aircraft (RPA) operated by a remote pilot.
"Unmanned traffic management UTM": UTM is an unmanned traffic management system used to manage the traffic of drones.
"Tariffs" means the fee payable for the use or purchase of all services provided through SERB’s website and shall exclude any VAT and additional charges.
"Terms" means these Terms and Conditions;
"Website" means www.flyserb.com
"You", "The user", and "Your", "the pilot" refers to you, the individual who has logged on to this website and has agreed to the Company's terms and conditions.
Third party: Any third party who is involved and in which users are directed to, in order to fulfill the purpose of this agreement.
"Personal information" means personal information you shared with Serb such as your name, age, personal picture.
"Transaction" the act of purchasing any services provided by Serb.
1) The clause, schedule, and paragraph headings have no bearing on the understanding of this agreement.
2) A person is a natural person, a corporation, or an unincorporated body (whether or not it has independent legal personality).
3) Any requirement in this agreement on a person not to do something includes an obligation not to consent, allow, permit, or acquiesce in that item being done.
4) All references to clauses and schedules are to the provisions and schedules of this agreement.

Contractual relationship and Consent:

Tahleeq for unmanned aerial vehicles Services LLC, a company with its registered office at xx, P.O. Box 123, (Registration number 1371523 ). Tahleeq for unmanned aerial vehicles Services LLC defined as ("Serb", "we", "us" or "our"), and by which expression includes Serb's relevant legal representatives, administrators, successors-in-interest, permitted assigns and affiliates ("Affiliates").
These terms of service constitute a legally binding agreement (the "Agreement") between you and Serb.
This Agreement governs your use of the SERB application, website, call center and technology platform (collectively, the "SERB Platform"). Generally, the right to operate the SERB Platform is licensed by SERB to its relevant Affiliates, and the relevant Affiliate in your jurisdiction provides you the right to access and use the SERB Platform in your jurisdiction. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE ACCESSING OR USING THE SERB PLATFORM. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU MAY NOT USE OR ACCESS THE SERB PLATFORM.
Access to Serb:
This agreement governs your use of SERB’s services. ("services" e.g, obtaining a flying permit, registering a drone, or purchasing a course, (Recreational Pilots guidelines: Pilot licenses)- (UTM service: drone registration, payload registration, incident reporting, flight operation log book, user reports, designated safe zones in oman, active flight information)
Subject to your compliance with this Agreement, Serb grants you a limited, non-exclusive, non-sub-licensable, revocable, non-transferrable license to:
access and use the Serb Platform on your personal device solely in connection with your use of the Serb Platform; and
(ii) access and use any content, information and related materials that may be made available through the Serb Platform, in each case solely for your personal, non-commercial use. Any rights not expressly granted herein are reserved by Serb and Serb's licensors.

Amendment to this agreement
SERB may amend this Agreement from time to time. Amendments will be effective upon SERB’s posting of an updated Agreement at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the SERB Platform after such posting constitutes your consent to be bound by this Agreement, as amended. Our collection and use of personal information in connection with the SERB Platform is as provided in SERB’s Privacy Policy located at https://www.flyserb.com SERB may provide to a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, which may include an accident, involving you and a third party provider and such information or data is necessary to resolve the complaint, dispute or conflict.
SERB retains the right to modify this agreement and add new or additional terms or conditions regarding your use of the services at any time. Such modifications and additional terms will be effective immediately and incorporated into this agreement. Your continued use of the services will be deemed acceptance of these changes.

The Serb Platform
The SERB Platform provides a digital network for all users ("Users") who seek to register as pilots, register drones, obtain AirPass, request flights, or take courses. Each User must create a User account to gain access to the SERB Platform. Any decision by a User to utilize or accept Services is made in such user’s sole discretion. Each Service offered to a User by the "pilot" or another third-party provider constitutes a separate agreement between such parties.
The materials on the SERB Platform are not intended to be used as advice. As a result, we disclaim all liability and obligation arising from any reliance placed on such materials by any visitor to the SERB Platform or by anyone who may be aware of any of its contents.
We intend to update the SERB Platform on a regular basis and have the right to change the content at any moment. If the necessity arises, we have the right to stop or terminate access to the SERB Platform and Services indefinitely. Any of the material on the SERB Platform or the Services may be out of date at any moment, and we are under no responsibility to update such material.

Third Party Services and Content
The SERB Platform may be made available or accessed in conjunction with third-party services and content (including advertising). SERB does not support such third-party services and material, and you agree that SERB will not be responsible or liable for any products or services provided by such third-party suppliers.
You further understand that SERB may be required to share personal information in the way stated in SERB's Privacy policy in order for a Merchant Partner to provide you with relevant goods or services.
As a courtesy, the site may include links to other websites. Some of these websites may or may not be linked with SERB.
SERB is not responsible for any online pages established and maintained by entities other than flyserb.com. You visit such third-party website sites at your own risk.
Serb Platform Ownership
The SERB Platform and all rights therein are and shall remain the property of SERB or its licensors. Neither this Agreement nor your use of the SERB Platform conveys or grants you any rights: (i) in or to the SERB Platform, other than the limited license granted above; or (ii) to use or refer to SERB's company names, logos, product and service names, trademarks or service marks, or those of SERB's licensors in any way.

Privacy:

To learn more about the use of their Personal Data, Users may refer to the privacy policy of SERB which is available through serb website.

Drone Operation Permit DOP:
You will receive an instant drone operation permit(DOP) from SERB of your flight request approval including all the necessary information. However, this confirmation letter might be delayed due to technical reasons faced or a glitch in the system. This includes any delays caused by the CAA or other competent/related authorities or other reasons.
Also, This DOP may be terminated at any time, with or without prior notice, in the event of a conflict with other manned flights or due to the emergence of a drone mission of greater priority.
The DOP is unique and is granted to each flight. Which means that obtaining the DOP for a certain flight doesn’t give you the permission to operate and fly at any time or zone.

Provision of services
SERB provides a variety of services, including, but not limited to: getting permissions, registering pilots and drone, flight booking requests and purchasing courses.
SERB's services may be removed or altered to improve user’s experience; additionally, SERB may introduce new services to the website for the same purpose.
Unless otherwise agreed in writing with SERB, all flight bookings will be made through the Website.
If the booked region is within the safe zone, pilots will receive instant flying approval.
The website offers many plans that cater to different consumer needs; make sure to select the proper plan depending on your needs and preferences. Otherwise, the user will be responsible for all costs and fees.
When you place a flight booking request or register drones or purchase a course you are offering to purchase that service based on these Terms. SERB reserves the right to decline or cancel your transaction, or any part of it.
After SERB receives your order for any of the services offered and, where applicable, payment of the Fee, you will get an email confirming receipt of your order.
The user will be charged per subscribed plan only, not per flight. Charges will apply to all plans and services purchased.
Flights and other services are subject to delay and cancellation in which all users will be notified of, All users will be notified through the app, phone number or email address provided at the registration step.
AirPass: The videos provided as part of the process to obtain a license are not mandatory. They are good to watch for additional information, but users can skip them if they choose.
SERB reserves the right to cancel or modify service fees at any time. All users will be notified whenever such changes occur.
After registration, you will be offered with a selection of services, each with its own set of requirements based on the customer's preferences.

For pilots:

2. Osfur
To qualify for the license, users must take an immediate photograph on the website; if the photo does not fit the requirements, the license will be denied.
After meeting the criteria and obtaining the required permissions, users may fly only in the requested safe zone. SERB is not liable for users who fly beyond the safe zones or the requested zones, since legal and security measures will be taken against them.
Users in Nawars and Osfur plan are only allowed to fly for two missions: drone racing and photography.
The unlimited flights are accessible for different durations depending on the plan. Some plans offer access for three months, while others provide six months. Additionally, there may be promotional offers such as "subscribe for three months and receive an additional three months free." SERB is not liable for users who do not utilize the free unlimited flights within the stipulated time frame.
Each flight has a maximum duration of 30 minutes; If the pilot requires more time, another flight must be scheduled. All plans offer an unlimited number of flights, allowing pilots to fly as many times as they want without any additional fees for flight hours.

Operating Permit
Upon successfully completing the knowledge test with a score of at least 85%, you will receive an operating license. By accepting this license, you agree to the following terms and conditions.
follow the remote piloted aircraft (drones) regulations CAR102 and fly safely and legally
make sure that you have the right authorization and permits for the type of flying you intend to do.
check that any drone or model aircraft that you plan to fly has all its registration documents present before you the flight.
Check that the drone complies with the CAA's and CAR 102's approved list.
Users must possess a valid license, have an active plan request, and operate within designated safe zones or obtain approval for flying in other zones.

Registration of Unmanned Aircraft System (UAS)

By applying to register an unmanned aircraft, you confirm that all those directly involved in the operations will be competent to perform their tasks, and the unmanned aircraft system will be operated only by remote pilots with the appropriate level of competency. This means you shall:

meet all legal requirements for being responsible for a drone or model aircraft
The pilot shall have access to all registration documents for each drone under their responsibility.
Pilots shall bear the cost for registering an unmanned aircraft (drone) which is non-refundable.
report Any changes or modification made to your drone and obtain the required permissions to do so.
If at any time, you fail to follow any of the conditions listed in this section or the CAA regulations, we may revoke or suspend your registration documents and/or operating permit
Pilots shall use the system approved permits to operate the unmanned aircraft system and make sure they maintain an active plan before actually flying the drone, otherwise the user shall bear all consequences.

Operating Permits:
You must register your drone through SERB in order to enjoy different kind of services and plans. To which you will get a flying permit in order to operate your drone.
Such a permit gives you the ability to operate your drone in the specified area and time by booking request.
Certain sections of airspace are temporarily or permanently off-limits to drones (No-fly Zones)
SERB have the right to refuse to grant a permit, or postpone or revoke a previously granted permit without the need to provide reasoning nor compensation.

Use of the SERB Platform
User's account:
Most features of the SERB Platform require you to register for and maintain an active personal User account ("Account"). To open an Account, you must be at least 18 years old
Account registration necessitates the submission of personal information to SERB, such as your name,email address and password
After completing the knowledge test, additional information will be required from the user such as: first and last name, phone number, ID number, gender, city, and date of birth.
You agree to keep your Account information true, complete, and up to date. Failure to keep your Account information accurate, complete, and up to date may result in your inability to access and use the SERB Platform, including the ability to request access to your personal information or opt in or out of marketing preferences, or SERB terminating this Agreement with you.
Upon registration and creation of your account, you will choose a username and password. It is imperative that you do not disclose your password to any other party for reasons of safety and security.
You declare to always keep your Account login and password secure and confidential. You accept and acknowledge that you are liable for all activity that occurs under your Account, even if the device through which you access the SERB Platform is lost, damaged, or stolen.
Airpass may only be obtained once by the user as it is linked ied to users ID number and personal picture.
If you believe your account has been compromised, please contact SERB immediately through the mentioned address in the website.
SERB reserves the authority to suspend any account upon detection of anomalous behavior or non-compliance with regulations, or upon request from law enforcement or security agencies.or upon other reasonable reasons.

Username and password policy:
Users will be able to create their own unique password, which will be deemed personal information and must not be shared with anyone else.
Users are advised to create a safe and uncommon password for safety reasons. Users are advised not to use the same or similar passwords to the ones used in other websites.
Users are advised to maintain an 8-character minimum length, as well as using multiple character sets which includes: uppercase character, lowercase character and non-alphanumeric character.
SERB will offer users to update their password, Which will help users to verify their identity if they ever forget their password or in case someone else tries to take over their account. In addition, it provides an out of band notification channel in the case of security events such as login attempts or changed password.

User Requirements and Conduct.
The SERB Platform is not accessible to persons under the age of 18 and may only be used by individuals who are legally capable of entering into legally binding contracts under relevant law. You may not authorize third parties to use your Account, and you may not allow anybody under the age of 18 to receive/use Serb's services. It is solely your obligation to follow all necessary safety precautions.
You are not permitted to assign or transfer your Account to another person or business. When using the SERB Platform, you promise to follow all applicable laws and to use the SERB Platform exclusively for legitimate reasons. To prevent confusion, you must not use the SERB Platform to operate or enable the operation of drones for illegal or forbidden purposes. You will not cause bother, annoyance, inconvenience, or property damage in your use of the SERB Platform, whether to another pilot, drone operator, other third-party provider, or any other party. In certain instances, you may be asked to provide proof of identity to access or use the SERB Platform, and you agree that you may be denied access to or use of the SERB Platform if you refuse to provide proof of identity.
Failure to comply with the requirements of this section may result in the following actions being taken against you: (i) immediate, temporary, or permanent withdrawal of your right to use the SERB Platform (ii) legal action against you, including proceedings for reimbursement of all costs incurred as a result of the breach (including, but not limited to, reasonable administrative and legal costs); (iii) disclosure of such information to law enforcement authorities as we deem necessary; and/or (iv) immediate, temporary, or permanent removal of all of your activities and bookings made through SERB.

In connection with the Services, you agree not to:
post, transmit, or otherwise make available through or in connection with the Services any materials that are or may be:
- threatening, harassing, degrading, hateful, or intimidating, or otherwise fail to respect the rights and dignity of others;
- defamatory, libelous, fraudulent, or otherwise tortious;
- obscene, indecent, pornographic, or otherwise objectionable; or
protected by copyright, trademark, trade secret, right of publicity or privacy or any other proprietary right, without the express prior written consent of the applicable owner.

SERB maintains the right to monitor all user activities and to terminate any account if any activity is deemed improper, objectionable, or violates these Terms and Conditions.

Charges and payments
Subscription fees: The Fee for any service at any given time will be displayed on the Website and the or will be notified to you by a SERB Customer Services representative. Fees are quoted and payment shall be made in Omani Rials, exclusive of VAT and any Additional Charges.
Users will only have one option for making the payment which is through the online payment method.
The payment will be processed by an external online payment provider cooperating with SERB.
If a payment through the offered methods fails or is refused by the payment service provider, SERB is under no duty to complete the purchase order. Any costs or fees incurred as a result of the failed or refused payment must be met by the User/pilot.
Card data will be stored for future orders by the external online payment providers, on the condition that the customer has given consent to the storage and for future usage,
SERB will not be held accountable under any circumstances for leaking or exposing any of the users' information by the third party provider.

If you subscribe to a plan on the Website:
A) The fee for purchasing a subscription plan, excluding VAT and any applicable delivery charges related to confirming flight bookings, will be shown prior to the completion of the online transaction; and

Prices:
Users are notified of any fees, taxes, and costs that they will be charged during the purchasing process and before submitting an order.

Plans cancellation by SERB:
- Flights may be delayed or canceled for safety reasons outside SERB's control.
- Users may cancel individual flights and request new flights without limitation.

Fraudulent activity
You undertake to contact SERB immediately if you become aware of any fraudulent conduct involving your User Account. Notifications can be sent through the SERB Platform or by email to ____@serbglobal.com. You are solely responsible for notifying your financial institution or payment services provider of any fraudulent activity involving a payment card stored in your User Account.
You acknowledge that SERB is not liable for unauthorized use of your User Account. SERB maintains the right (at its sole and absolute discretion) to stop or cancel any transaction if we suspect it is related to fraudulent, unlawful, illegal, suspicious, or criminal behavior, or if you are otherwise in violation of this Agreement.
If we become aware, or have reason to believe, that your User Account is being used in an unauthorized, unlawful, improper, or fraudulent manner, or for criminal activities (or has previously been used in this manner), or if you fail to comply with applicable laws and regulations, or any of the conditions relating to the use of the Services, including this Agreement, SERB may, in its sole discretion, take certain actions against you, including terminating your User Account.

Notification
Users will be able to receive notifications from SERB with reminders or other timely information about various activities that demand their attention even while they are not using the website.
Notification includes but not limited to the following:
weather condition updates
expired plan
successful payment
rejection of payment
Users will be held completely responsible if they do not allow the website to send notifications, as these messages/notifications may include important information regarding flight delays and cancellations, changes or cancellations to any service, changes and cancellations to fees and rates, changes in the terms and conditions and so on.
SERB is not liable for users who do not check the notification center for any airspace limitations that may result in flight delay or cancellation.

Intellectual property:
You agree that the Services, including but not limited to Content, user interface, educational content permits, flight requests and the scripts and software used to implement the Services, contain proprietary information and material that is owned by SERB, its licensors and/or Content providers, and is protected by applicable intellectual property and other laws, including but not limited to copyright.
Limitation of liability
To the extent not prohibited by law, in no event shall SERB be liable for the misuse of the services or content provided.
The pilot is obligated to utilize the booked area with all due diligence, the pilot will be held liable for any misuse of the areas or drone.
If the Pilot utilizes an area other than the one booked, the user is responsible for any commercial or personal damages or losses.
When flying any unregistered UAS in any area, the pilot is liable for all the legal and safety consequences.
The pilot shall be held liable for using any other zones than the one booked
If SERB or any competent authority delays or cancels a flight booking for safety or security concerns, pilots will be notified immediately. Failure to comply with these flight delays and cancellations will result in legal consequence.

If any of the scenarios mentioned in the occur, all users will receive standard notifications containing all the necessary information which exclude SERB’s liability from any consequence.

Severability
In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination and suspension of services:
- If you fail, or SERB suspects that you have failed, to comply with the provisions of this agreement, SERB may, without notice to you: terminate this agreement and or terminate your account or preclude your access to the services. You will remain liable for all amounts due under your account up to and including the termination date.
- SERB further reserves the right to modify, suspend or discontinue the services at any time with or without notice to you.

Security:
SERB agrees to maintain commercially acceptable technical and organizational safeguards against unauthorized disclosure and modification of its systems. This Platform and the Services are provided 'as is' with no warranties of any kind, and your use of the Services is entirely your responsibility. We make no promises, express or implied, about the accessibility, quality, or suitability of this Platform or the Services.
There may be times when the Services are unavailable due to reasons such as necessary maintenance or circumstances beyond our control, for which we will never be held liable.

Indemnification
You agree to indemnify, defend and hold harmless SERB, and its officers, directors, employees, agents, and contractors from and against any and all claims, costs, demands, damages, liabilities, or expenses, including, without limitation, reasonable attorneys’ fees, arising from or related to: (a) the User Content you provide or submit via the SERB Service, (b) your use of the SERB Service, (c) your breach of these Terms or the T&Cs, or (d) any actual, prospective, completed or terminated service between you and a third party.

Miscellaneous

This Agreement does not, and shall not be construed to, create any partnership, joint venture, employer-employee, agency or franchisor-franchisee relationship between you and SERB.
If any provision of this Agreement is found to be unlawful, void or for any reason unenforceable, that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provision.
You may not assign, transfer or sublicense any or all of your rights or obligations under this Agreement without our express prior written consent.

Assignment
Without SERB's prior written agreement, you may not assign or transfer your rights under this Agreement in whole or in part. You authorize SERB to assign or transfer its rights and duties under this Agreement in whole or in part, including to: (i) a subsidiary or affiliate; (ii) a purchaser of SERB's equity, business, or assets; or (iii) a merger successor. As a result of your contract with SERB or usage of the SERB Platform, no joint venture, partnership, employment, or agency relationship occurs between you and SERB.

Governing law:
This agreement shall be construed, interpreted and governed by and in accordance with the laws of the sultanate of Oman.

Dispute resolution:
You agree that any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof or the use of the SERB Platform or Services shall be governed and construed in accordance with the laws of the Sultanate of Oman. Each Party submits to the exclusive jurisdiction of the Sultanate of Oman's competent court.

Other provisions:
This Agreement constitutes the entire agreement between you and SERB and governs your use of the Services, superseding any prior agreements with respect to the same subject matter between you and SERB.
You also may be subject to additional terms and conditions that may apply when you make Transactions or use affiliate services or additional services If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
SERB’s failure to enforce any right or provisions in this Agreement will not constitute a waiver of such or any other provision. SERB will not be responsible for failures to fulfill any obligations due to causes beyond its control.
